2. Preamble

This covenant is entered into between the driver named above (the "Driver") and Brakel Fleet Management Limited ("Brakel"), in association with {{ $kijiwe?->name ?? 'the Driver\'s Kijiwe community' }} ("the Kijiwe").

The Brakel Fleet system operates on a collective accountability model. Vehicles are owned by investors and managed by Brakel, but day-to-day accountability is shared within each Kijiwe community. This covenant formalises the Driver's commitment to that shared responsibility.

3. Driver Commitments

The Driver agrees to the following obligations as a member of the Kijiwe:

  1. Daily Payments. Make the agreed daily payment on or before 21:00 EAT each operational day. Payments made after the deadline are recorded as late and affect the Driver's individual score and the Kijiwe's collective score (BDQ).
  2. Vehicle Care. Maintain the assigned vehicle in roadworthy condition, report defects promptly, and present the vehicle for all scheduled maintenance. Failure to comply reduces the Driver's contribution score.
  3. Kijiwe Accountability. Acknowledge that persistent non-payment affects the entire Kijiwe's collective score and reduces the community's ability to receive new vehicle allocations. The Driver accepts the community's authority to apply peer accountability measures consistent with the Kijiwe charter.
  4. Vehicle Auction on Terminal Default. Acknowledge that in the event of a terminal payment default, the assigned vehicle will be released into a 60-minute Kijiwe inheritance auction open to waitlisted drivers in good standing. The Driver waives any claim to continued vehicle use once the auction is initiated.
  5. Covenant with Waitlisted Drivers. Treat waitlisted community members with respect, share information about the system fairly, and not discourage eligible drivers from applying for vehicles through the standard auction process.
  6. Document Compliance. Keep all personal and licensing documents current. Expired documents must be renewed within the grace periods specified by Brakel and shared with the operations team promptly.
  7. Honesty. Never provide false information to Brakel, the Kijiwe committee, or investors. Misrepresentation is grounds for immediate termination of contract and Kijiwe membership.
  8. Contribution to the Community. Where capacity allows, participate in relief shift coverage, buffer fleet support, and approved referral activities. These contributions improve the Driver's contribution score and waitlist position.

4. Brakel Commitments
  1. Transparency. Provide the Driver with access to their individual score, payment history, and Kijiwe collective score at all times through the Brakel driver portal.
  2. Fair Process. Apply all scoring, penalty, and auction rules consistently and without discrimination. Disputed decisions may be escalated through the BMEO appeal process.
  3. Maintenance Support. Fund scheduled maintenance from the vehicle's maintenance reserve, subject to the Driver presenting the vehicle as required.
  4. Waitlist Integrity. Manage the Kijiwe waitlist by contribution score and seniority, and conduct vehicle inheritance auctions fairly within the 60-minute window.
  5. Legacy Fund. On successful TTA contract completion, distribute 50% of unspent reserves into the Kijiwe Legacy Fund for community use, subject to BMEO approval.

By signing this covenant, the Driver confirms that they have read, understood, and agree to all terms above. The Driver acknowledges that this covenant is a condition of Kijiwe membership and vehicle assignment eligibility under the Brakel Fleet programme.

This document does not constitute a vehicle contract. A separate Vehicle Assignment Contract (VAC) will be issued when a vehicle is allocated through the auction process.
